Q Digital 2021 Best of GayCities Sweepstakes Rules 

The 2021 Best of GayCities Sweepstakes ("Sweepstakes") is open to legal residents of the contiguous 48 United States and the District of Columbia age 18 and older at the time of entry. Sweepstakes begins at 12:01 AM Pacific Time ("PT") on November 14, 2021 and ends at 11:59 PM (PT) on December 15, 2021 ("Sweepstakes Entry Period"). Sweepstakes is sponsored by Q.Digital, Inc. ("Sponsor"), 584 Castro St. #623, San Francisco, CA 94114. Employees of the Sponsor, Q.Digital, Inc., and their parent, subsidiaries, affiliates, advertising and promotion agencies and their immediate family members and/or those living in the same household of each are not eligible to enter. Subject to all applicable federal, state and local laws and regulations. Void where prohibited by law. By participating in the Sweepstakes, each entrant (i) agrees to be bound by these Official Rules, including all eligibility requirements, and (ii) agrees to be bound by the decisions of Sponsor and Q.Digital, Inc. which are final and binding on all matters pertaining to the Sweepstakes. 

To Enter 

To enter, visit www.gaycities.com/best-of-2021/ and follow all entry instructions. All entries must be received during the Sweepstakes Entry Period. Entrants subject to all notices posted online at any time during the Sweepstakes, including, but not limited to, the privacy policy. Limit: Limit to twelve entries per day per email address. All entries and requests become Sponsor's property and will not be returned or acknowledged. Sponsor is not responsible for lost, late, mechanically reproduced, damaged, or misdirected entries. 

Prize & Approximate Retail Value ("ARV") of Sweepstakes 

The grand prize is to be awarded to one (1) entrant and consists of: 

·       A credit of up to $500 to be used at a hotel stay - $500.00

Approximate ARV of grand prize: $500.00. Odds of winning depend on number of eligible entries received. Certain restrictions may apply. Winner will be selected in a random drawing from all eligible entries received. Random drawing will be conducted on or around 12/20/2021 by a representative of Q.Digital, Inc., whose decisions are final. Winner shall be notified by email and has forty-eight (48) hours from notification to respond and accept the prize. Prize awarded within fifteen (15) days after winner confirmation. If a prize is returned as undeliverable, it will result in disqualification, and the corresponding prize will be awarded to an alternate winner. No substitutions are permitted except if prize is unavailable, in which case a prize of equal or greater value will be awarded. Prize is not redeemable for cash. Prize is non-assignable or transferable. Winner is responsible for all federal, state, local and sales and income taxes. Any other incidental expenses on prize not specified herein are the sole responsibility of winner. Entry and acceptance of prize constitute permission to use winner's' name, prize won, hometown and likeness for online posting and promotional purposes without further compensation, except where prohibited by law. Limit: one prize per household.

In the event that any potential winner (a) cannot be contacted directly by Q.Digital within forty-eight (48) hours from initial attempted notification, (b) fails to satisfy any eligibility or verification requirement herein, (c) declines to accept the prize, (d) or is otherwise determined to be ineligible, Q.Digital in its discretion may disqualify that individual and an alternate winner may be chosen by random drawing to be held as soon as reasonably practicable after initial winner is determined to be ineligible. Alternate winners are subject to all eligibility requirements and restrictions of these Official Rules. Q.Digital may conduct up to two (2) alternate drawings. If Q.Digital is unable to confirm an eligible winner after two (2) alternate drawings, no further drawings will be conducted and the prize will not be awarded. 

Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, prize providers or any other persons providing any prize-related services or accommodations. Sponsor is not liable for any missed prize events, opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. No refund or compensation will be made in the event of the cancellation or delay of any transportation or other prize element except at the sole and absolute discretion of Sponsor. Lost, stolen or damaged airline tickets, travel vouchers or certificates will not be replaced or exchanged. 

General 

Participating entrants agree to these official rules and the decisions of the judges and the Sponsor, and release the Sponsor and their affiliated companies, and all other businesses involved in this Sweepstakes, as well as the employees, officers, directors and agents of each, from all claims and liability relating to their participation, acceptance and use of prize. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Sweepstakes or use or redemption of prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the sweepstakes, or in the announcement of the prize. Winner may also be required to sign other legal documents, including tax forms and a release supplied by Q.Digital that, among other disclaimers, releases Sponsors and a range of subsidiaries, directors, agents, agencies, affiliates, franchisees, promoters, officers, directors, employees and related persons from any and all liability related to this Sweepstakes and the receipt and use of prize. 

Q.Digital reserves the right to cancel, terminate or suspend this Sweepstakes or any part of this Sweepstakes should any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, or other causes beyond its control, corrupt or impair the security, administration, fairness and/or operation of this Sweepstakes as determined by Q.Digital in its sole discretion, at which time, Q.Digital will select the winner by conducting a random drawing from among all non-suspect entries received at the time of the Sweepstakes cancellation, termination or suspension.

Confidentiality 

Information provided by you to participate in this Sweepstakes is subject to the opt-out and privacy policies for the Sponsor and Q.Digital. 

Disputes 

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants, Q.Digital and any other Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Louisiana, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of Louisiana. Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules shall be instituted only in the federal or state courts located in the State of Louisiana, Orleans Parish and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. 

NOTICE TO ONLINE ENTRANTS 

In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsor is not responsible for: (i) lost, late, misdirected, damaged, or illegible entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the Sweepstakes. By participating in the Sweepstakes, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any sweepstakes it sponsors any person it believes has intentionally violated these official rules; and (ii) withdraw the online method of entry if it becomes technically corrupted, (including if a computer virus or system malfunction inalterably impairs its ability to conduct the sweepstakes), and to select winner(s) from among all eligible entries received prior to withdrawal.
